Real Estate Scams and Fraud are becoming more common. The Office of the Eagle County Clerk and Recorder offers a free Recording Notification Service that will send an email alert to customers when a document is recorded using a monitored name. With this service customers can request the monitoring of up to five different names per registered email address. The names provided must match the name (Grantor/Grantee) on the document recorded into public record. Click here, to search documents already recorded.

If signed up for this service, when a document is recorded into the public records using a monitored name, a notice will be sent to the email address the service was set up with. It is the responsibility of the property owner to consult legal counsel, notify law enforcement, and/or take appropriate legal action if it appears to the property owner that a fraudulent document has been recorded.

What can I do to protect myself from property fraud?
Property and mortgage fraud occurs when fraudulent deeds are recorded, making it appear as if the title to the property has been transferred. Therefore, you could periodically check the Official Public Records using the Recorded Document Search to see if there are documents fraudulently recorded in your name.

You can also sign up for the Eagle County Clerk’s free Recording Notification Service in order to receive automated email alerts when a document is added to the Official Records using a monitored name. Although this service does not prevent the actual fraudulent activity from occurring, it does provide an early warning of what may have otherwise gone undetected.

Lastly, if your property is vacant:

  • Check your property often to make sure it is not occupied illegally.
  • Ask someone you trust to look after your property if you are away for an extended period of time.
  • Ask the postal service to hold your mail or sign up to have it forwarded while you’re away.
  • Make sure the Eagle County Assessor and the Eagle County Treasurer offices have the correct mailing address for you or the person who should receive notices about your property.


 
Why do fraudulent documents get recorded?
The Eagle County Clerk and Recorder’s Office must record all documents presented that meet statutory requirements. The Clerk and Recorder’s Office cannot verify the legality or accuracy of the documents recorded/filed.
If a document is proven fraudulent, can it be removed from the Official Records?
A document cannot be removed from the Official Records, but a court order or other document may need to be recorded to clear a title.Therefore, customers are urged to contact local law enforcement and/or an attorney for prompt, appropriate action if fraud is suspected.
What should I do if I think I may be the victim of property fraud?
Contact your local law enforcement and/or your attorney or legal advisor. Eagle County Government cannot take legal action on your behalf to reverse any alleged fraudulent activity.
What documents will I be notified about through the Recording Notification Service?
The Recording Notification Service alerts you to documents recorded, from the day you signed up for the service, that match a name you’ve identified to be monitored.
How do I edit the names being monitored?
To edit the names/parcels you are monitoring please use the following steps:

  • Select the UPDATE SUBSCRIPTION option toward the bottom of the Recording Notification Service page.
  • Type in the email address the subscription was created with and click submit.
  • Check your email for further instructions.
  • Note the verification number in the email you received and click on the link provided.
  • Enter the verification number and click submit.
  • Update/edit the names and/or parcel numbers you've been monitoring and click the update button.

  • Select the REQUEST A LIST OF REGISTERED NAMES option toward the bottom of the Recording Notification Service page.
  • Type in the email address the subscription was created with and click submit.
  • Request Successful
  • Check you email for a list of the names and parcel numbers you are currently monitoring.

Can I unsubscribe from the Recording Notification Service?
To unsubscribe or stop monitoring name/parcels please use the following steps:

  • Select the UNSUBSCRIBE option toward the bottom of the Recording Notification Service page.
  • Type in the email address the subscription was created with and click UnSubscribe.
  • Check your email for further instructions.
  • Click on the link provided in the email you received.
  • Cancellation Successful
