Foreclosure Process Suspension Policy

With Executive Order D 2020 012, Governor Polis authorized the County Public Trustees to suspend all processes related to active foreclosures and to suspend processing and recording of foreclosure notices of election and demand received after March 20th for 30 days. This suspension of activities will end on April 20, 2020.

It is common, when a Governor is overriding state law, to limit the executive order for 30 days to allow the Legislature to take action. Should the legislature not act within that time period, and the situation that brought on the need for the Executive Order still exists, it is possible that the Governor will extend those provisions.

THE POLICY:

Our office will not continue to process newly received foreclosures until April 20, 2020. As far as active foreclosures go, all statutory deadlines will be followed as normal. Exceptions to this approach may be granted for COVID 19 related economic hardship on a case by case basis, and determined by the Eagle County Public Trustee. Barring extension of the suspension timeline by the Governor, new foreclosures will be accepted and processed as normal beginning April 20, 2020.
