Juvenile Arrested in Homicide

Gypsum, Colo. – Tuesday, May 6, 2014 at 2 p.m. - At a news briefing today, Eagle County Coroner Kara Bettis confirmed the identity of the victim as Joseph Kelly, Jr., who resided at 483 Vicksburg Lane, Gypsum, Colo. The cause of death was two gunshot wounds to the head. The manner of death is homicide. Bettis stated that the state of the victim’s body was consistent with the death taking place approximately six days ago. Kelly was shot twice in the head with a .22 rifle. One wound was to the back of the head and one to the temple, Bettis said. 

The victim’s 13 year old son Kai (rhymes with sky) Kelly, has been identified as the suspect. At this time the motive is still under investigation. A petition was filed by the Fifth Judicial District Attorney’s Office today listing charges of First Degree Murder, Criminal Mischief, and a Crime of Violence sentence enhancement.

Joseph Kelly was a 5-year employee of Eagle County Government’s ECO Transit Department.

Gypsum, Colo. – Monday, May 5 , 2014 at 11 p.m. - On Monday, May 5, 2014 at approximately 11:30 a.m., a deputy with the Eagle County Sheriff’s Office stopped at a residence in Gypsum, Colo. The deputy was attempting to locate the father of a juvenile who was under investigation for graffiti. The father of the juvenile was scheduled to meet with deputies on April 30 to discuss the graffiti investigation, but he never showed up.

Early this morning the father’s employer contacted the Eagle County Sheriff’s Office. They informed deputies that the juvenile son had called in, several days in a row, stating that his father was ill and would not be at work. This seemed suspicious prompting deputies to perform a wellness check. During the wellness check the juvenile answered the door and told deputies that his 50-year-old father was deceased in the residence.

The victim’s 13-year-old son, Kai Kelly, was taken into custody and is being booked into the Eagle County Detentions Facility and will be transported to Mount View Youth Detentions Facility on charges of first degree murder.

This is still an active investigation.
