Candidacy by Petition

According to the Colorado Constitution Article XXVIII Section 2, a person is a candidate for election if the person has publicly announced an intention to seek election to public office and thereafter has received a contribution or made an expenditure in support of the candidacy.  See this Becoming A Candidate Quick Reference Guide.

A hard copy 
Candidate Affidavit must be filed with the Colorado Secretary of State within ten days of meeting the above criteria.

Petitions and other candidate filing forms are available upon request from the clerk and recorder's office or online where links are indicated.

Number of signatures and dates are based on 2012 Statutes.

Major Political Party Candidate Petitions

  • Must be registered to vote in Eagle County.
  • Candidate must have been affiliated with Republican or Democratic Party no later than the first business day of the January immediately preceding the Primary Election held on June 24, 2014 (last Tuesday in June).  (Eligibility requirements apply unless otherwise provided by party rules.  Potential candidates are encouraged to contact local party chairs for more information.)
  • Major political party candidates who wish to petition onto the primary election ballot must contact the clerk and recorder's office for the appropriate petition forms: teak.simonton@eaglecounty.us  
  • Candidates who attempted to gain designation by the assembly and received at least 10 percent of the votes cast may be placed in nomination by petition.
  • No person attempting and failing to receive at least 10 percent of the votes for the nomination of a political party assembly for a particular office shall be placed in nomination by petition on behalf of a political party for the same office.
  • Must have signers equal to 20 percent of the votes cast in the county for the party's candidate for this office at the last primary, or the last general if there was no primary. See chart below for specific signature requirements.
  • Signers of Major Political Party Candidate Petitions must be affiliated with the major political party named in the petition for at least 29 days as shown on the records of the Clerk and Recorder, and the signer cannot sign any other petition for any other candidate for the same office.
  • Proceed to Campaign and Political Finance

Minor Party Candidate Petitions

  • Must be registered to vote in Eagle County.
  • Must have been affiliated with the minor party no later than the first business day of the January immediately preceding the general election for which the person desires to be placed in nomination.  Eligibility requirements apply unless otherwise provided by party rules.  Potential candidates are encouraged to contact party chairs for more information.
  • Minor political party candidates who wish to petition onto the ballot must contact the clerk and recorder's office at teak.simonton@eaglecounty.us for the appropriate petition forms.
  • Must have signers equal to 2 percent of votes cast for all candidates for that office in the most recent general election.
  • Signers of Minor Party Candidate Petitions may be unaffiliated or affiliated with any party. The signer cannot sign any other petition for any other candidate for the same office.
  • Proceed to Campaign and Political Finance

 Unaffiliated Candidate Petitions

  • Must be registered to vote in Eagle County.
  • Candidates must have been unaffiliated no later than the first business day of the January immediately preceding the general election for which the person desires to be placed in nomination.
  • Unaffiliated candidates who wish to petition onto the general election ballot must contact the clerk and recorder's office at teak.simonton@eaglecounty.us for the appropriate petition forms.
  • Must have signers equal to 2 percent of votes cast for all candidates for that office in the most recent general election
  • Signers of Unaffiliated Candidate Petitions may be unaffiliated or affiliated with any party.  The signer cannot sign any other petition for any other candidate for the same office.
  • Proceed to Campaign and Political Finance

 Who may circulate petitions for signatures

  • Anyone circulating a petition for a candidate for county office must be a resident of the state, a citizen of the United States, and at least 18 years of age.
  • For a partisan candidate petition, the circulator must be affiliated with the party at the time the petition is being circulated as shown by the registration books of the clerk and recorder.

Who may sign candidate petitions

  • Commissioner candidate petitions may be signed by eligible Eagle County electors who live in any of the three county commissioner districts.
  • For petitions to nominate candidates from a major political party, each signer must be affiliated with the party for at least 29 days at the time of signing as shown on the registration books of the county clerk and recorder.
  • Petitions to nominate candidates from a minor political party or unaffiliated candidates may be signed by any eligible Eagle County elector.
  • No elector may sign more than one petition for each office.
